    It's a flawed comparison. The American justice system has a much greater burden of proof than these unofficial courts and though it does primarily operate as a system of punishment, it also functions as a deterrent to crime. It's not perfect, but it mostly provides an acceptable trade-off that results in net fewer people harmed than if it didn't exist.

    The article 9 courts have apparently done nothing to deter sexual assault: They have increased the likelihood of the guilty being punished while also increasing the likelihood that the innocent will be punished. That, to me, is not an acceptable trade off.
    Title 9 isn't about punishment, though. It's about taking care of the victims. It's legal purpose and justification is about providing a safe educational environment.

    You're arguing that the potential risk to an innocent person's reputation (all a school can really damage) should be prioritized over punishing the guilty.

    What you are inadvertently saying is that the hypothetical risk to an innocent person's reputation is more important than the safety of very real victims.
    Rape is just a really tricky legal issue and that goes for both sides. I don't doubt at all that many people get off of rape charges that are guilty, but you can also be sure some guys get accused purely because their partner for the night regrets it later. But the principle of innocent until proven guilty, in a court, has to be the way you do things. Reputations do matter a lot, people's lives can be changed forever by such false accusations, and punishing the innocent in order to ensure you also catch the guilty is just not a good enough reason.
